Darklemoner Photography Terms of Business
CONTRACT This contract between DarkleMoner Photography LLP and the Client shall not become effective until it is signed and the initial amount due has been paid.
TERMS It is mutually agreed that the following terms and conditions form an integral part of this contract/invoice and that no variation or modification of this contract shall be effective unless accepted by DarkleMoner Photography LLP in writing.
BOOKING FEE A booking fee (varied depending on session) secures the time and services of DarkleMoner Photography LLP for the wedding or event. This is deducted from the total price.
CANCELLATION At the time the contract takes effect, DarkleMoner Photography LLP shall reserve the date and time agreed upon, and not make any other reservations or accept any other Clients for said date and time. For this reason, in the event that the Client cancels the contract for any reason, DarkleMoner Photography LLP reserves the right to charge a cancellation fee in accordance with the following scale: The booking fee (varied), in order to offset its loss of business. In the event of the Client cancelling a booking for a wedding or event 30 days before the date, all monies paid shall be retained by DarkleMoner Photography LLP in order to offset its loss of business. All cancellations must be in writing. Should the cancelled wedding or event turn out to be a postponement, then subject to availability on a new date, monies other than the booking fee may be applied to the new wedding.
PAYMENTS The balance of the payment for the services contracted for must be paid for 30 days before the wedding or event date. Sessions booked close to the date will be required to settle payment before services commence. Payment for additional albums and Photo Books etc. are to be made prior to ordering. Any bank charges incurred due to returned cheques will be debited to the Client.
Payments can be made by bank transfer, PayPal, cheque or cash.
FORCE MAJEURE In the event of DarkleMoner Photography LLP having to cancel photographing the wedding or event, due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc., or in the unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid by the Client. In this instance DarkleMoner Photography LLP will also do their utmost to put the Client(s) in touch with another photographer.
Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure. Your statutory rights are not affected.
DarkleMoner Photography LLP has Public Liability and Professional Indemnity Insurance.
WEATHER AND/OR DELAYS Weather permitting, the photographs will be taken as agreed. In the event of inclement weather, the photographer, in co-operation with the Client, will make the necessary changes to the schedule and will do her best to produce coverage of the wedding or event within the time allocated to her. Similarly, when delays occur due to circumstances outside her control, the photographer will stay on beyond the agreed time but may charge an additional fee for extra time involved.
REQUESTED PHOTOGRAPHS DarkleMoner Photography LLP will honour requests for specific photographs subject to the following: weather and time permitting, availability and the cooperation of the person(s) concerned.
EXTENDED SERVICES On the day of the wedding or event, the Client and DarkleMoner Photography LLP may agree to extend services at the rate of £100/hr, charged per 30 minute intervals (£50 every 30 minutes).
COVERAGE DarkleMoner Photography LLP cannot be held responsible for the lack of coverage caused by the bride, groom, partners or other members of the wedding party or event not being ready on time, nor by restrictions placed on the photographer by officials of the church, register office or licensed marriage venues or other locations. DarkleMoner Photography LLP does not guarantee any specific picture nor to include any specific background, location, props, or arrangement, although every effort will be made to interpret the client’s wishes. DarkleMoner Photography LLP is limited by the guidelines of the ceremony official or reception site management. The Client will obtain all permissions necessary for the Photographer to photograph at the ceremony and venue(s). The Photographer has no duty to obtain permission of reception centres, churches, buildings, properties, or other locations to operate thereon. The Client understands and agrees that any failure to obtain these permissions resulting in fines to photographer, or which prevent photographer from photographing the event(s) is not the fault, liability, or responsibility of photographer.
GUEST COOPERATION The Client is responsible for the conduct of their guests. The Client will direct all other service providers (florist, DJ, caterer, etc.) to provide any needed information and cooperation to the photographer. Coordination with other service providers is necessary to complete all the photography sessions as scheduled.
COLOUR MATCHING The dyes used for clothing, particularly manmade fibres do not always photograph in the way they appear to the eye. When the photographs are printed to produce a pleasing flesh colour such materials may appear incorrect. 'DarkleMoner Photography LLP' will endeavour to achieve to closest possible colour match within the limitations of the materials and processes used.
CHROMATIC ABERRATION Chromatic Aberration, also known as “colour fringing” or “purple fringing”, is a common optical problem that occurs when a lens is either unable to bring all wavelengths of colour to the same focal plane, and/or when wavelengths of colour are focused at different positions in the focal plane. Chromatic aberration is caused by lens dispersion, with different colours of light travelling at different speeds while passing through a lens. As a result, the image can look blurred or noticeable coloured edges (red, green, blue, yellow, purple, magenta) can appear around objects, especially in high-contrast situations. DarkleMoner Photography LLP will try to minimize this wherever possible.
RETOUCHING All images will be adjusted for exposure, brightness, contrast, sharpness etc. DarkleMoner Photography LLP holds judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost.
COPYRIGHT The images remain the property of DarkleMoner Photography LLP for the use of advertising and other purposes. DarkleMoner Photography LLP will issue Clients who purchase a USB with a 'Print Release'. this allows Clients' to reproduce unlimited prints, canvases, albums, t-shirts etc. for personal use. The print release allows Images to be posted on all forms of social media. You must include a link to my work as the photographer (www.facebook.com/darklemonerphotography). The Client will not edit the images in any way (including cropping, Instagram filters etc). The Client will not claim the work as their own. The client shall obtain written permission from DarkleMoner Photography LLP prior to selling or publishing any of the material for financial gain.
DELIVERY TIMES DarkleMoner Photography LLP aim to provide the final wedding/event photography images to the Client within 1 – 3 weeks (this may be longer during peak periods).
PRINTs, ALBUMS, PHOTO BOOKS and other photo products DarkleMoner Photography LLP will design, create and order products that are included in a photography package. images for inclusion will be chosen by the client. we can also supply these products if requested separately by the Client. DarkleMoner Photography LLP will use a recommended printing company to fulfil the request. There will be a fee for the product(s) requested ( including delivery ) and a fee for DarkleMoner Photography LLP for work carried out on creating the order. Darklemoner Photography LLP Accepts no responsibility for the quality and colour reproduced from third party printers due to variations inn paper and third-party printing processes and profiles, printing company delivery times may vary.
MODEL Release The Client hereby grants DarkleMoner Photography LLP and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases DarkleMoner Photography LLP and its legal representatives and assigns from all claims and liability relating to said photographs. However, discretion is important to us. DarkleMoner Photography LLP will consider any request for anonymity.
GDPR Personal data such as names and contact details submitted to us in an enquiry are only used for the purpose of responding to your enquiry. This information is never shared with any other parties. Personal details collected in the online ordering system is only used for distributing purchased goods and updating you on ordering information. We will never contact you for any other reason, nor share your information with any other parties. Payment information is never held on file. Card payments taken by us will be processed by the card terminal merchant via PayPal, and no sensitive data is held by us. The data you supply as part of your booking form will be held securely at Darklemoner Photography LLP This data will be held for a maximum of 12 months, until the tax year is complete.
As you have a large number of guests in attendance at your wedding, it would be impossible for us to get everyone there to sign a form allowing us to use the images from the day for marketing the business. I would ask that the couple holding the wedding send a group email or a note in the invites to make them aware they may be part of your images used to advertise from your wedding. By signing a contract and ticking both tick boxes to say you have understood this and passed it onto your guests you are Agreeing to the terms for GDPR regulations on behalf of your guests.
PERSONAL ACCIDENT Any directions issued to clients or their guests during a photographic shoot are deemed to be at said persons’ own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot at a wedding or event.
SAFETY DarkleMoner Photography LLP will not undertake any work with heat, or at heights above three metres, or with heavy machinery, or engage in manual labour. DarkleMoner Photography LLP preserves to right to terminate coverage and this contract, and leave the location of the wedding or event if the photographer representing DarkleMoner Photography LLP experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the wedding or event(s). In such circumstances, the monies paid will be non-refundable.
REFUND POLICY We will not refund, nor accept the return of/refusal to pay charges, for any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.
